Deliveries
JBay Deliveries enables the Client to order Meals from Restaurant Operators and arrange the delivery of the Orders to the Drop-Off Location.
Menus and prices may vary at time of order being placed, if prices has increased when delivery is collected by us difrence to be paid by customer on delivery to driver.
Delivey items may vary from pictures displayed on website. Opening and closing times may vary of suppliers.
We are a delivery service and not the supplier, any complaints about orders or food must be dealt with directly with suppliers.
All products listed are subject to availability at time of order collected.
Products for sale on our website excludes delivery and service fees.
If customer provides incorrect delivery zone they will be required to pay the diffrence when receiving delivery.
Once order is placed customer is responsble for the payment of goods and delivery fee.
Prior to the Food being delivered to your nominated address or you being notified that the Food is ready for collection (as applicable), we may reject an order or cancel a Sale at any time due to: (i) the Restaurant being unable to fulfil the order; (ii) Driver Delivery services not being readily available (if applicable); and/or (iii) any other reason in JBay Deliveries sole discretion.
Should you wish to retract your order, you should contact JBay Deliveries via telephone immediately, and JBay Deliveries will use its reasonable endeavours to effect such retraction. You will not be able to retract your order via the Site/App, or after an Acceptance Notice has been generated. You will not be able to change your order after placing it, but may be able to retract it (subject to the above), and place a new one.
You also acknowledge that the pricing of Food may change at any time without notice to you, but no price change will affect any Food ordered in respect of which you have received an Acceptance Notice, except in the case of an obvious pricing error.In the event of an obvious pricing error, we may reject your order or cancel the Sale at any time and you will be entitled to a refund of the amount paid by you for such order.
It is your responsibility to establish from the relevant Restaurant which ingredients will be used when preparing the Food and make the necessary arrangements with such Restaurant to exclude any ingredients if you have any allergies or special requirements (unless such exclusions can be made by you on the Site/App). We cannot and do not guarantee that the Food will be free of allergens and we disclaim any liability relating to any ingredients or allergens contained in Food.
JBay Deliveries may not deliver liquor or tobacco products to you if you are under the age of 18 (regardless of any supervision by a parent or guardian). You may be requested to provide proof of your age before receiving any liquor or tobacco products ordered via the App. The Courier Delivery or Self-collection of any liquor or tobacco products may be refused and you will be held liable for all charges relating to such order, should you fail to provide adequate proof that you are 18 years of age or older, or if you appear to be under the influence of drugs or alcohol at the time of delivery or collection of such products.
Although we will try our best to deliver your food orders within the indicated timeframe, to help ensure the safety of our drivers, delivery times may be affected due to bad weather and/or traffic conditions.
Service is subject to availability. We reserve the right to reject any order.

Payment may be made via Visa
and MasterCard.

Card acquiring and security
Card transactions will be
acquired for
JBay
Deliveries via
PayGate (Pty) Ltd who are
the approved payment gateway
for all South African
Acquiring Banks. PayGate
uses the strictest form of
encryption, namely Secure
Socket Layer 3 (SSL3) and no
Card details are stored on
the
website. Users may go
to www.paygate.co.za to view
their security certificate
and security policy.

Customer details separate
from card details
Customer details will be
stored by
JBay Deliveries
separately from card details
which are entered by the
client on PayGate’s secure
site.
9.
Merchant Outlet country and
transaction currency
The
merchant outlet country at
the time of presenting
payment options to the
cardholder is South Africa.
Transaction currency is
South African Rand (ZAR).
10.
Responsibility
JBay
Deliveries takes
responsibility for all
aspects relating to the
transaction including sale
of goods and services sold
on this website,
customer
service and support, dispute
resolution and delivery of
goods.
11.
Country of domicile
This
website is governed by the
laws of South Africa and
JBay
Deliveries chooses as
its domicilium citandi et
executandi for all purposes
under
this agreement,
whether in respect of court
process, notice, or other
documents or communication
of whatsoever nature.
12.
Variation
JBay
Deliveries may, in
its sole discretion, change
this agreement or any part
thereof at any time without
notice.
